Appellant, Turhan Wynn, filed a complaint in the Court of Appeals for Cuyahoga County for a writ of mandamus to compel appellee, Cuyahoga County Court of Common Pleas Judge Timothy McCormick, and Cuyahoga County Probation Officer Charlene Shaft, to serve written notice of Wynns alleged probation violation and conduct a hearing concerning the violation. Judge McCormick filed a motion for summary judgment, attaching his September 1997 judgment, which indicated that he had held a hearing on the probation violation, that Wynn had been fully advised of his constitutional rights and represented by counsel at the hearing, that he had found Wynn to have violated his probation, and that he had revoked Wynns probation and ordered him to serve the remainder of his original sentence. The court of appeals granted Judge McCormicks motion and denied the writ.
