¶1 Lucas McElwee appeals from a judgment of conviction for operating while intoxicated (OWI)--third offense. McElwee pled no contest after the trial court denied his motion to suppress. McElwee contends that the arresting officer's use of physical force and handcuffs to detain him, and a pat-down search converted a temporary stop into an arrest not supported by probable cause. He contends that the arrest was invalid and seeks to suppress all evidence gathered after the arresting officer used the handcuffs.
